Welcome to MyMedha, a digital platform owned and operated by Attitude & Intelligence Learning Systems ("AILS").
These Terms of Service ("Terms") govern your access to and use of the MyMedha website (mymedha.org), including any assessments, AI-generated insights, PDF reports, dashboards, and related services (collectively, the "Services").
By accessing, registering for, or using the Services, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.
1. Eligibility
To use the Services, you must be capable of forming a legally binding contract.
In compliance with the Digital Personal Data Protection Act, 2023, if you are under the age of 18, you may only use the Services with the verifiable consent and supervision of a parent, legal guardian, or authorized educational institution. By creating an account, you represent that you meet these eligibility requirements.
2. Description of Services
MyMedha provides strength-based career and personal development assessments (such as the Chaitanya and Sparsh assessments). The Services include the administration of these assessments, automated scoring, and the generation of insights and reports.
Educational & Advisory Purpose Only
The assessments, generated reports, and AI-driven insights provided through MyMedha are intended strictly for educational, developmental, and self-reflection purposes.
You acknowledge and agree that:
- Not Medical or Psychological Advice: The Services do not constitute medical, psychological, psychiatric, or professional counseling advice. They are not intended to diagnose, treat, or cure any mental health or psychological condition.
- No Guaranteed Outcomes: AILS does not guarantee that using the Services will result in academic success, specific employment, career advancement, or any other particular outcome.
- AI-Assisted Analysis: Certain portions of your report are generated using Artificial Intelligence (AI) models based on your numerical scores. While we strive for accuracy, AI-generated content is advisory and should be interpreted alongside your own personal judgment and, where applicable, professional human guidance.
3. Account Registration and Security
To access most features of the Services, you must register for an account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are responsible for safeguarding your password and account credentials. You agree not to disclose your password to any third party and to notify us immediately at privacy@mymedha.org of any unauthorized use of your account.
- University Cohorts: If you are accessing the Services via a University Enrollment Code, you acknowledge that certain data, including your assessment progress and reports, may be shared with your university administrators in accordance with our Privacy Policy.
4. Intellectual Property Rights
All content, features, and functionality of the Services - including but not limited to assessment methodologies, algorithms, text, graphics, logos, icons, images, audio clips, data compilations, and software - are the exclusive property of AILS or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws.
- Limited License: AILS grants you a limited, non-exclusive, non-transferable, and revocable license to access the Services and download/print your personal assessment reports solely for your personal, non-commercial use.
- Restrictions: You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Services or the underlying assessment methodologies (e.g., Chaitanya, Sparsh) without prior written consent from AILS.
5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Cheating or Manipulation: Attempting to manipulate assessment results, gaming the system, or providing intentionally false responses to distort the data.
- Account Sharing: Sharing your account credentials or University Enrollment Codes with unauthorized individuals.
- System Interference: Interfering with, disrupting, or attempting to gain unauthorized access to the servers or networks connected to the Services.
- Data Scraping: Using any robot, spider, scraper, or other automated means to extract data from the Services.
- Commercial Use: Reselling or repackaging the assessments or reports for commercial gain.
AILS reserves the right to suspend or terminate your account immediately, without prior notice, if you violate any of these rules.
6. Payments and Refunds
If you are accessing the Services through an institutional partnership (e.g., your university), your access fees are governed by the agreement between AILS and your institution.
If you purchase individual access to an assessment directly through the MyMedha platform:
- All fees are clearly stated at the time of purchase.
- Refund Policy: Due to the digital nature of the Services, once an assessment has been commenced or a report has been generated, all sales are final and non-refundable, except as required by applicable law.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
AILS makes no warranties, express or implied, regarding the reliability, accuracy, or uninterrupted availability of the Services.
In no event shall AILS, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, career opportunities, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Services;
- Any reliance placed by you on the assessment reports or AI-generated insights;
- Any unauthorized access, use, or alteration of your transmissions or content.
In no event shall AILS's aggregate liability for all claims relating to the Services exceed the amount paid by you to AILS for the specific service in dispute.
8. Indemnification
You agree to defend, indemnify, and hold harmless AILS and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.
9. Modifications to the Services and Terms
- Changes to Services: AILS reserves the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.
- Changes to Terms: We may revise these Terms from time to time. The most current version will always be posted on the MyMedha platform. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.
